1. Acceptance of Terms

By accessing and using MyBayad ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and MyBayad. We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

2. Description of Service

MyBayad is a personal finance management application designed to help users track and manage their debts, including credit cards, loans, Buy Now Pay Later (BNPL) services, and informal debts (utang). The Service includes:

• Debt tracking and payment logging
• AI-powered financial insights via Gab assistant
• Emotional UX modes (Calm, Control, Crisis)
• Google Calendar integration for payment reminders
• Household debt coordination features
• Dashboard customization and analytics

The Service is provided "as is" and is intended for personal, non-commercial use only.

3. User Accounts

To use the Service, you must create an account using Google OAuth authentication. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Be at least 18 years of age

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

You retain ownership of your financial data. You may export or delete your data at any time through the Service's data management features.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Impersonate any person or entity
• Share your account credentials with others
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for commercial purposes without authorization
• Harass, abuse, or harm other users

6. Household Features

If you use household features to share debt information with family members:

• You are responsible for obtaining consent from household members before inviting them
• Household admins have access to shared debt information and activity logs
• You may leave a household at any time; your personal data will no longer be shared
• Disputes between household members are not the responsibility of MyBayad

7. AI Assistant (Gab) Disclaimer

Gab, our AI assistant, provides suggestions and insights based on your financial data. Gab is NOT a financial advisor. You acknowledge that:

• Gab's suggestions are for informational purposes only
• AI-generated content may contain errors or inaccuracies
• You should consult qualified financial professionals for major financial decisions
• MyBayad is not liable for decisions made based on Gab's suggestions

8. Financial Information Disclaimer

MyBayad is a tracking and organizational tool only. The Service:

• Does NOT provide financial, legal, or tax advice
• Does NOT process actual payments or transactions
• Does NOT connect to bank accounts or payment processors
• Relies on user-entered data which may contain errors

You are solely responsible for verifying the accuracy of your data and making informed financial decisions. Consult qualified professionals for financial advice.

9. Intellectual Property

The Service, including its design, features, content, and code, is owned by MyBayad and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service without permission
• Use MyBayad trademarks or branding without authorization
• Create derivative works based on the Service

You retain all rights to your personal data. By using the Service, you grant us a limited license to process your data to provide the Service.

10. Third-Party Services

The Service integrates with third-party services including:

• Google OAuth: For authentication
• Google Calendar: For payment reminders
• Google Gemini: For AI assistant features
• Supabase: For data storage
• Sentry: For error monitoring

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or changes.

11. Limitation of Liability

To the maximum extent permitted by law, MyBayad shall NOT be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenues, data, or goodwill
• Financial losses from decisions based on Service information
• Service interruptions, errors, or data loss
• Unauthorized access to your account
• Third-party actions or service failures

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or PHP 5,000, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless MyBayad, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

13. Termination

We may suspend or terminate your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Extended inactivity (12+ months)
• Request from law enforcement

Upon termination, you may request export of your data within 30 days, after which it will be permanently deleted.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
